The Clarksburg Village Community is a development project of Elm Street Development of McLean, Virginia. Elm Street Development is a local, privately held firm that has developed over 200 communities in the metropolitan area, including over 40 in Montgomery County. In 1984, Elm Street began to acquire the 740 acres that would become Clarksburg Village. Over the past 20 years there have been numerous meetings and public hearings concerning the general development of the Clarksburg area and, more specifically, on the plans for Clarksburg Village. During these years, governmental approvals were obtained for the Clarksburg Master Plan as well as the Preliminary Plan, Infrastructure Plan, and Phase I, II and III Site Plans for Clarksburg Village. As the developer, Elm Street performs the preparation of the site including the installation of the water and sewer mains, streets, and sidewalks as well as the amenities (pool, tot lots, pathways) and common areas which will eventually belong to the homeowners association. The completion of these items is the responsibility of the developer and home builders. The Association will then become responsible for the maintenance once they are completed. In the case of the development of Clarksburg Village, Elm Street sells "finished lots" to the various homebuilders, including Beazer Homes, Craftmark Homes, Craftstar Homes, NV Homes, and Ryan Homes. The builders then construct and sell the homes (and lots) to you, the homeowner. When you purchased your home at Clarksburg Village, you automatically became a member of the Clarksburg Village Community Association. The Association was established through the creation of the Declaration of Covenants, Conditions, Easements and Restrictions (Declaration) and the By Laws. These "legal documents" were filed with the State and local government prior to beginning development. The Declaration is a document that is filed in the Land Records and "runs with the land" meaning that all deeds for all lots in Clarksburg Village are "subject to" the provisions of this document. The Declaration spells out the requirements for budgeting, collection of assessments, the architectural control process and other "use restrictions" for the community. The By Laws are an associated document that is largely administrative in nature and establishes criteria for meetings, elections, voting, etc.. All homeowners were provided with these documents in a large disclosure package at the time that the contract of purchase was made. Everyone is encouraged to read these documents carefully.
