RELEASE WAIVER

ASSUMPTION OF RISK FOR PARTICIPATION IN ECSC SWIMMING PROGRAMS

Eagle Community Swimming LLC offers the opportunity to participate in a wide variety of recreational activities. All participants, however, should be aware that many recreational and fitness activities involve substantial risks of bodily injury, property damage, and other dangers associated with participating in such activities. Dangers peculiar to recreational and fitness activities normally engaged in include, but are not limited to: broken bones, strains, sprains, bruises, drowning, concussion, and heart attack. Each participant in the activities should realize that there are risks, hazards, and dangers inherent in such activities and in any training, preparation for and travel to and from such activities. Each participant in the recreational and fitness activities at the Woodruff P.E. Center and the Student Academic and Activity Center (SAAC) on the Emory University campus must be covered by an accident and health insurance policy. The University, Jon Howell and Eagle Community Swimming LLC does not warrant or guarantee in any respect the competency or mental or physical condition of any instructor. The University, Jon Howell and Eagle Community Swimming LLC also does not warrant or guarantee in any respect the physical condition of any of the equipment used in connection with any activity. Therefore, in consideration of being permitted to access and participate in the Eagle Community Swimming LLC recreational and fitness activities at the Woodruff P.E. Center and the SAAC and the benefits received from such recreational and fitness activities, the undersigned voluntarily assumes all risks of damages or injury including death, that may be sustained by the participant while participating in such recreational or fitness activities or in any travel to or from such activities.

RELEASE, COVENANT NOT TO SUE AND WAIVER


For the sole consideration of Emory University, Eagle Community Swimming LLC and Jon Howell allowing the participant identified below to participate in such recreational and fitness activities for which, or in connection with which, the University, Eagle Community Swimming LLC, and Jon Howell have
made available any equipment, facilities, grounds or personnel for such activities, the undersigned hereby agrees to release, covenant not to sue and forever discharge, indemnify and forever hold harmless, and on behalf of himself or herself and the undersigned?s heirs, representatives, executors, administrators, and assigns, does hereby release, covenant not to sue and forever discharge, indemnify and hold harmless Eagle Community Swimming LLC, Jon Howell, or Emory University and its trustees, officers, agents, employees, students and volunteers of any and for all claims, demands, rights and causes of action of whatever kind or nature, (with the exception of gross negligence or willful misconduct), including but not limited to negligence, unforeseen bodily and personal injuries, damage to property, and the consequences thereof resulting from participation in, or in any way connected with such recreational and fitness activities. The undersigned understands that this Release, Covenant Not to Sue, Waiver, and Assumption of Risk shall be effective unless and until Emory University, Eagle Community Swimming LLC, Jon Howell receives written notice of revocation from the signatories hereto, which notice must be sent to the address listed above.

 

Emory Community Swimming Photo/Video Consent Form

 

I grant Emory Community Swimming Photo/Video permission to use any photographs in Emory Community Swimming’s own publications or in any other broadcast, print, or electronic media, including without limitation newspaper, radio, television, magazine, internet. I waive any right to inspect or approve my depictions in these works.

I agree that Emory University may use such photographs of me or my children with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

 

Policies and Procedures

Registration Process


 All registrations will be taken through the www.emorycommunityswimming.com

  • All registrations are first-come, first-served
  • The registration program is live and you will be able to see which classes are filled and how many spots remain. Once you sign up and pay for a class, you are in that class. You can't secure a spot in a class without payment. If you choose to send in a check, you are placed on the waitlist until the check is received.  If there is still space available in the class when your payment arrives, you will be added to the class.
  • All classes have minimum enrollment numbers needed to run the class.  If you register for a class and the minimum is not met, we may cancel the class and will contact you to explore options.
  • If you would like your child placed in a class with a friend, please coordinate your registration and register at the same time for the same class. For other special requests, please email us and we will do what we can to accommodate, but we can never guarantee special requests.
  • We may change the classes offered during the registration process based on demand.  If the only class you can attend is filled, please sign up for the waitlist and email us ([email protected]).  We will explore adding a class, if it is possible. 
  • NO REFUNDS or exchanges after registration

General Class Policies

  • If you miss a class for personal reasons (such as vacation or illness), no make-up lessons are allowed.
  • Swim diapers should be used if your child is not potty-trained.  Swim diapers must be used at all times for all children enrolled in Seahorses whether potty-trained or not.
  • Only members of the facility have access to the pool before/after lessons or workout areas during swim lessons.
  • Questions and/or concerns can be addressed to John Petroff, the program coordinator on site after class time.
  • Special circumstances that can't be resolved with the program coordinator on site can be addressed to [email protected] or call (404.727.5302).

Class/Safety Policies

  • A lifeguard will be on duty during each class time.
  • A Program Coordinator will be at each class session, monitoring the classes and answering enrollment/class questions, and helping with instruction when needed.

Outdoor SAAC Pool and Inclement Weather Policies

  • If the pool is closed by the lifeguards or the SAAC, classes will be cancelled.
  • Classes will take place if it is raining, but the pool has not been closed due to thunder and lightning.
  • On days with inclement weather, we will record a weather update approximately 30 minutes before classes start. There are times when we are forced to cancel classes within 30 minutes of the start.  We do our best to give you notice of cancellation, but it is hard to predict the weather and conditions can change quickly.  Please refer to the ECSC lessons line for weather updates (404) 712-2154.
  • Fridays will be reserved for rain-out lessons only. Our goal is to make up every class missed for weather, but we can’t guarantee all classes will be made up if there are multiple cancellations due to bad weather. If you can?’ attend the Friday makeup session, we are not able to provide alternative makeup options

Parking

  • Parking is free of charge in the Peavine parking deck across from the Woodruff PE Center during all group lesson times.  Parking is free of charge in the SAAC Parking deck for all afternoon/ evening classes (the parking deck opens at 3:45pm) and weekend classes.

Facility Information
